Mr. Moe's is suing the city over 5 am closing time
According to correspondence received:
"Since the effective date of the rollback legislation in June, 2008, every venue in the Grove which operated until 5:00 am has closed, with the sole exception of Mr. Moe's and the collateral effects of the absence of meaningful nightlife in Coconut Grove can now been seen in the form of empty store fronts and vacant businesses of all types throughout Coconut Grove, as recently reported by The Miami Herald. Commissioner Sarnoff’s misguided initiative, coupled with the general economic turndown, has adversely affected virtually every business in Coconut Grove.
"Mr. Moe's has tried since prior to the enactment date of the rollback legislation in February, 2008, to work out a compromise with Sarnoff’s office to exempt bona fide restaurants that were granted the right to and did in fact operate and sell alcoholic beverages until 5:00 am for years without incident in Coconut Grove, to no avail, despite Sarnoff’s promise to Mr. Moe's owner, John El-Masry, to do just that. El-Masry now asserts his legal right and demands a jury trial to not only reverse the illegal rollback of the operating hours at it relates to his venue [which is today the only remaining nightlife venue in Coconut Grove that operated to 5:00 am prior to the rollback] but to seek $10 million in damages and lost revenue and attorney’s fees from the City of Miami as a result of Commissioner Sarnoff’s personal crusade and ill advised initiative."
