Village Council wants your input

This in from Patrick Sessions, the Chairman-elect of the Village Council:

To: All Coconut Grove Residents, Residential Associations, Business Owners, Commercial Associations, and interested individual parties.

From: Patrick Sessions, Chairman-elect, Cocoanut Grove Village Council

As you are undoubtedly aware, there is an ongoing debate in Coconut Grove regarding the 3 am versus 5 am bar/restaurant closing times. In June, 2008, a revision to the Miami City Code went into effect which changed the closing times to 3 am for Coconut Grove. Specifically, the underlined language was added at that time:

“(6) The hours of sale for alcoholic beverages by the following establishments are weekdays, including Saturday, from 7:00 am to 5 am on the following day; Sunday, from 12:00 noon to 5 am on the following day, except in the SD-2 Coconut Grove Central Commercial district where the hours of sale for alcoholic beverages by the following establishments are weekdays, including Saturday, from 7:00 am to 3:00 am on the following day; Sunday, from 12:00 noon to 3:00 am on the following day:
a. Nightclubs;
b. Supper clubs;
c. Hotels, motels and apartments with 100 or more guestrooms;
d. Any of the establishments (above) in a retail or waterfront specialty center.”

Commissioner Sarnoff has announced that he will hear discussion on this issue at the second January, 2010 Commission meeting. At his request, the CGVC will be speaking at the Commission meeting on this issue and therefore the Council is seeking input from all interested parties and organizations regarding their position on this issue. As mandated by its By-Laws, “The Cocoanut Grove Village Council shall promote and advance the interest of, and represent the people of Coconut Grove, Florida, before governmental and other entities having any impact on the people who live in the area defined as Coconut Grove.” You elected us, and to fulfill our obligations and responsibilities to you, we are seeking input from you, the “people” both residential and commercial, of Coconut Grove. While we had some input at our previous meeting, additional information would be helpful.

Therefore, I’m asking that prior to or at our next scheduled meeting on December 16, 2009, that you or your organization give us your official position on this issue, either by sending an authorized representative to the Council meeting or emailing your position to us at patsessionscgvc@aol.com.

Your choices are as follows:

1. Leave the ordinance as it is and keep the closing time at 3AM in the Grove business district.

2. Request that the revision pertaining to the 3 AM closings in the SD2 Grove Commercial District be rescinded and that the Grove be treated the same as other business districts in the City and allow qualified establishments be open to 5 AM.

It should be pointed out that there is currently only one establishment in the Grove with a 5 am license and that is Mr. Moe’s, so in the event that the 3 AM closings were rescinded and put back to 5 am, Mr. Moe’s would be the only establishment “grandfathered in”. Any other establishments seeking a 5 am license would be required to meet all applicable governmental standards and requirements for a 5 am license.

I would request that you provide us with as much information as you can or would be willing to share. If you are a member of an organization, that includes, but is not limited to:

The name of your organization.
Your position in your organization.
The type of organization, ie; residential, commercial, ect.
The number of members.
The area your group encompasses.
Whether your vote was determined by a vote of your board or by the full membership.
The actual count of your board or full membership for or against the existing ordnance.

The Council needs your input to best represent the interests of the people of the Grove to the City Commission and others. Many of us in the Grove have strong positions on issues that affect Coconut Grove, but are “guilty” of not taking the time or effort to make ourselves heard. The Coconut Grove Village Council is one opportunity for you to be heard, and for your voice to be then heard by others.

The newly elected Cocoanut Grove Village Council will be sworn in at the upcoming December 16, 2009 meeting and we look forward to your participation on this and other important Coconut Grove issues.

POLICE POLICE POLICE!!!
Take note from Mayor Guiliani in NYC.. He turned the city around by putting a cop on every corner...and letting the businesses stay open and thrive!!!
Remember... the point of closing establishments early in the Grove was to curb crime.. not hurt businesses!!!
If the policy is changed AGAIN.. and places can stay open late AGAIN.. and crime goes up AGAIN.. it will do more harm than good.

I vote for # 1., because I do not believe the two hour difference will have a positive financial affect in Coconut Grove. Additionally, Since my family lives close to down town Grove I don't want people who think it's okay to drink all night long into the early AM hour of 5:00 PM in my neighborhood. I had art placed about Coconut Grove and every morning in the early AM people high on alcohol would try to harm the art. I know because I went out and watched them on about 10 occasions with beer cans and mixed alcoholic beverages in plastic take out cups. I'm not much on going out and about in public while consuming alcohol and I don't think people should drink and then drive. For those who live and walk, why do you throw you alcohol containers up and down the streets close to down town. Take em home with you. And if you have an opinion about my opinion keep it to yourself and express you own opinion.

I find it hard to take anyone who spells coconut as "cocoanut" seriously. I also find it extremely difficult to take Jobie seriously.

That said, I'm under the impression that a 3am vs 5am closing time for bars really doesnt make a difference in how much business the Grove gets. HOWEVER, it is unfair to place one specific area of the City of Miami under such rules while the rest of the City, including a bar less than .5 miles away, are under different rule.

It is spelled "Cocoanut," the old way, this was the original spelling of Coconut Grove. So I think maybe people who don't know the history here and want to put others down before knowing the facts might be the ones who are not taken seriously.

I know it's not favorable to post this on this site, but I agree with Jobie and Anon 7:18. We're not saving the Grove by allowing people 2 more hours of drinking. No, I don't think there will rivers of vomit, or wrecked cars on every corner if we go to 5 am; I just don't see allowing people to drink longer as a magic bullet. We need to take a good look at what brings locals and tourists who spend money to the Grove. I don't think it's knowing they can drink until 5 in the morning.

And yet, Natalia, you are against allowing it for what other reason? Since it is spot zoning and the rest of Miami is 5 am, 7 am and 24 hour, why can't the Grove go back and try it and if it fails, then it fails?

We feel it is them knowing they can drink until 5 in the morning because they have told many of us time and time again, that it is all a perception issue. This is FACT, not made up rhetoric.

You know, the issue is not that every single person who would like to be in a bar hanging out with friends is going to be drinking all night until 5am. That's absurd.
Young people just like a place to go, then walk or take a short taxi ride home. Let the establishments be open till 5am, make sure the noise ordinance for outdoor noise is in place, and have a fun village again. And yes, have police presence! Take a look at Center Grove from the viewpoint of a tourist or part-time resident or a young professional. Pretty dated and in need of sprucing up and moving forward, not back in time.

I think that its funny, not to pick on Natalia in particular, when people say they are against equality for grove businesses (that's what this is about), "because 2 hours won't save the grove".

This isn't a save the grove issue per se. This is a "do not put coconut grove at a competitive disadvantage with the rest of south florida issue."

Why would anyone open a business in the grove when it is more restrictive than any other area. The rent is too high for the foot traffic, which is a separate but tangentially related issue, and the restrictions along with unequal code enforcement and a vindictive commissioner make it unattractive.

So, what you have is smart people with good ideas opening somewhere else, and more empty store fronts in the grove than at any time in its history.

Removing this restriction is one opportunity to A) put grove businesses on an even playing field with those they compete against, and B) tell Commissioner Sarnoff that this is OUR grove,, not his grove, and it will be run on OUR vision, not his vision.

I'm not really sure what your advocating. You first tell us to take a note from NYC Mayor Guliani who had a cop on every corner and allowed "businesses to stay open and thrive" then you go on to say that if the law changes AGAIN we'll have more crime..

Of course it's about Law Enforcement, as the first bloggers here suggests. You keep the noise to civil levels, have cops walking around, public intoxication, disorderly behavior, littering, etc. And that's at ALL hours, especially from 11pm to 3am, then until the next day, with more cops then and on weekends. That's all. As long as people and business BEHAVE and follow the LAW, let us stay there there, all night, all day, all year. This ain't a totalitarian system, North Korea or something. Until, of course, Papa Sarnoff stepped in, just a year ago with this ridiculous draconian rule, sending us to bed like Coral Gable high school kids.
(Or sending many to enjoy Night Life else where, many of them driving back here intoxicated at all hours, 1, 2 or 5am)
The Grove did just fine for Decades without this dumb rule, with the SAME freedom rules as all other cities around us. And that was with poor Law Enforcement. Decades. CI

I think that all bars and restaurants, not only Moe's with it's type of liquor license, should be able to stay open until 5. The Grove has been on the decline for years because other areas of Miami are now 'cool'(South Beach is definitely the location compared to 15-20 years ago when the Grove was it, and other areas like Sunset, the Design District, etc are now hipper places) and putting any more restrictions on us will just further kill the village, especially in the current weak economy. Take a walk on the streets behind Mayfair-it's an absolute ghost town- in addition to the empty spaces all over the rest of the Grove. Relax the rules and let the Grove thrive again. It's not the only thing that's going to save the village, but it's the one that's the least costly.

And for those of you who complain because you live in the Center Grove and don't want noise or people walking along: except for a handful of people who have lived there for a very long time, you choose to move to and live in an area with a vibrant and loud downtown area. If you didn't want that, you should have moved to the North or South Grove.

Beat cops, an end to the Grove's unnatural boom/bust housing cycle which prices young creative people/couples out and litters the community with poorly built dumps (but nice on the outside!), investment down Grande Ave, the return of the Grove theatre, the rehabilitation of the Ace theater into an art house cinema, and the destruction of that crappy chain-store mall would do wonders for the Grove.

The demographics/financial powerful/taxpayers of the Grove are mostly family with infants and children and single professionals who probably have much better things to do than concern themselves with or engage with alcoholic beverages being sold till 5:00 AM, personally or otherwise. They're probably at home sleeping getting sufficient sleep and rest to maintain a healthy lifestyle and remain alert at their jobs.

Anon 2:14, Yes, go to Demographics, Coconut Grove, Wikipedia and you'll find how many families and average income, professions-----not to mention there are numerous baby carriages being pushed about, few junk cars in this demographic, many expensive dogs, nice churches, grand homes, an attempt at the construction and financing of new businesses on Grand, etc, etc,and etc. which one cannot have if one stays out to early AM consuming alcoholic beverages on a regular schedule.

Seriously though, I guess we should ban gun ownership for the grove, because most people don't own one, and if you go around shooting people you can't be very productive in society...

Let's make it illegal to manufacture or sell cars that go over 55 since that's the speed limit, and no one should ever go faster than that.

Let's outlaw fast food - since if you eat it you'll be fat and lazy and a drag on the economy. Then you'll need health care, and society will have to pay for that, and certainly you'll have alot of sick days, and you'll be constantly checking your blood sugar to deal with the diabetes, and those ups and downs will decrease your productivity.

Let's outlaw skateboards, because those punks aren't productive members of society and they mess up traffic and scare people on the sidewalks, which should only be used by persons pushing a baby carriage.

Let's outlaw staying awake past midnight, because without a full nights sleep, and starting your day at 8 am, there's no way we can have a nice house or car or life or society otherwise...

Jobie, let me ask you this, did the demographic that you describe exhist here two years ago, or is this a new phenomenon? They must have replaced all the Frat boys, sorority girls, local alcoholics, hooligans, and people that don't work or hold down a job because the businesses were doing about %50 more volume then than they are today.
Are you saying that businesses on Grand can't be developed if certain businesses are allow to stay open til 5Am?
Go tell South Miami, Mary Brickell, Wynwood, MiMo etc.... They're developing at an incredable pace in large part to the vibrant night life, and yes 5am closings.
Your rant about expensive dogs, homes, cars etc. is asinine. All of those things exhisted in the Grove long before your hand learned how to paint, and guess what.. OUR VILLAGE WAS THE PLACE TO BE. For DECADES the Grove's downtown business district was THE place to be entertained. Now, sadly because of old fuddy duddys like yourself, who had their day in the sun now wish to prevent others from having similar experiences. Isn't that a shame.

FACT, Grove demographics prove the average annual income is about $63,000.00, family oriented and both male & female professionals.
You don't find these folks out & about 3:00/5:00AM. For folks that are, there's Moe's & Laugerhead. I used my name as a magnet and baited for opinions that are far less than professional so we Grovites can see, first hand, your collective hate, anger and frustration at not being in mainstream Grove. Your collective comments PROVE why the vast majority of Grovites don't want you folks in and about our community under the influence. Why do you think we have DUI check points? You're the folks that don't slow for stop signs, speed bumps, baby carriages, pets, bicyclyst & pedestrians and throw out your containers so the police can't charge you with open alcoholic containers. And if you don't drink, write some more hate comments about someone who could care less if bars open 24/7. I just wanted to expose your collective mentalities to demonstrate your attitude, i.e., alcohol & rage. This is what we do not want in our community or any community, anywhere---world. Thank You!

I thought it would be interesting to show the professionals who run the Grove, those who will influence the outcome got a good look at you all. If you can't concentrate on the real issue, how can you concentrate under the influence after consuming alcohol till the sun comes up? You'll be home sleeping it off while the votes are being counted.

Jobie, with all due respect, the "professionals who run the Grove" are all FOR 5 am. They want their business to return.

The Chamber, the BID, the Village Council and every other Group is for it whether they have spoken out in public about it yet or not.

It's a perception issue, and while I am totally for it, you won't find me out at 5 am drinking nor will you find many here who are for it out at 5 am.

We are for an even playing field. Either take the 5 am and 7 am away from the rest of Miami, or give it back to the Grove.

Grape, also with due respect, a level playing field? That a nice retort. Show me one comment from the pack tonight that slightly inferred the mentality is to accomplish a level playing field. Most comments were of a personal nature or kill the messenger. Most commenters suffer from the illusion something is being taken away from them personally, so they respond like a pack of dogs. The fact is we have Moe's and Big Daddy to consume alcohol, so it simply cannot be an issue involving 3:00 vs 5:00 AM or even about free choice----so what is this about? It started with Sarnoff and a few others being mentioned as some villainous anti Grove characters, being called mafia communist trying to destroy the Grove by specifically somehow having closed down bars @ 3:00 AM. So, tonight I stepped in using my name and if you noticed no one mentioned Sarnoff. So, give him a break and pay attention to my name, attack my name is what this pack did. If every bar in the Grove stayed open until 5:00 AM, how could that help the Grove? Where is the math? So, I admit, I wanted to show responsible professionals, those who read the Grape that there is what I will call a rat pack that will pounce upon anyone even slightly connected to the real movers and shakers, the professionals in the Grove, that in the end will do what is best for the Grove, even if it is their own image. It is my opinion that people who attack others in the Grape for posting an honest opinion should be identified as misantropic in nature and given no credibility. Their only purpose is to oppose and attack. Frankly, they have no authority or power and I wanted to demonstrate some basic psychology 101 about this 3 vs 5AM closing. I was asked my opinion and I state again, we have Moe's & Big Daddy's and the free choice to go else where if we choose. P.S. Thanks for allowing me to make my point. I'll make no more comments on the subject.

Mr. Moes is not opened till 5am. The real point is why do we only care about drunk driving in SD-2. I live in the Grove I have been hanging out in the Grove for 20 yrs. I along with many of my friends, who are professionals, have spent many nights in the Grove partying till 5am. A lot of us now go to Brickell, and when were are done we drive back to the Grove.
If staying open till 5am won't help anything then how can it hurt. If you believe it won't bring more people to the Grove then you have nothing to worry about. It will be just the same drunk people who were here at 3. Now they just won't have to get in their cars and drive to Flannigan's.
Level the playing field. Bring back 5am and Bring back Vision too!

anon 3:10, is there a proposal in the pipe line for such a consideration? I've read something about California law allowing for about 76 separate locations coupled with the Fed making a statement that they would not arrest such establishments, but is there something going on in Florida?

If you are an alcoholic or a bar-owner you must favor the petition. If you own real estate in Coconut Grove and you are not part of the above group, then you should obviously be concerned.

I'm neither a bar owner or an alcoholic, I'm a property owner (albeit on the wrong side of the tracks on Shipping)that has owned a home and two rental properties for the past 16 years. I'm offended that because I'm in favor of bringing back the same hours that we had for quite some time that I'm being attacked.

One of my rental properties has been sitting there vacant for nearly 9 months. In 16 years none of my properties stayed vacant more than 2 and a half months.
I've spoken to others experiencing the same thing.

Your property may remain vacant for many reasons! Is your rent to high? Do you provide a washer and dryer, do you or your neighbors have barking dogs, is the property maintained, sit next to high power electrical overhead lines, are the bathrooms clean, is there fresh paint, etc. I have duplexes and mine have been rented every day since 1989 and I have none of the above. Times are hard now, did you adjust accordingly, I did. I do not rent to alcoholics, rent to smokers or people who use drugs hit women or are mean and nasty to their pets. Are you coming even close to connecting your lack of renters to the subject matter of this blog, the 3:00 AM closings?

Jobie, Natalia etc...I have a 2 year old son with a baby carriage, a dog and a decent home on Virginia St in the Grove. (somehow my son, by the grace of God, has managed to dodge all the drunk drivers out at 5am while he waits for his school bus..and thank God for the Sarnoff Circle- saved his life atleast ten times). I lost my job when sarnoff dedided to change the rules in the middle of the game and stop selling after 3 am. My employer couldn't keep me and 9 others on staff due to the loss of revenue by that liar Sarnoff. I moved to the Grove because the place I worked at made money, A LOT of money between the hours of 3 and 5. Not only are there customers who want to stay out late, but 100 service industry people who get off work at 3am and want nothing more than a burger and a beer after a long day. Here is a little economics lesson... its called supply and demand...If there was not a demand for 5am in the Grove for the past 30 years, no one would supply it; it would cost too much. But you people pass judgement on the way we choose to live our lives, and for me..how I make my living to support my son and his baby carriage etc...cut me a break. You moved here knowing the 5am law was in place. If it was that important to you, you and your dog, baby carriage etc would have moved to Broward because everywhere else in Sarnoff's district stay open till 5am...

Well said, Chris!!!!!!! I'm one of the old - not bitter - hens in the North Grove, and I totally support the 5am closings. I also on a condo in Center Grove. Please everyone see the fairness and reason in Chris' posting.

It would appear to me, judged by what you stated that Sarnoff is your babies best friend amigo, side kick, parter, God Father type, care taker beside you and/or your immediate family.

I move into the Grove in 1965 and found bars open just about 24/7, drugs, loose men and women and couples, a lot of artist thrown in and raised five children without one incident. I've lived in central Grove and could care less about bars and drugs because I do not engage in such stuff. I don't give a hoot if 100 bars stay open 24/7 and naked folks are running about all over downtown Grove. And if they were I would certainly go downtown and have a look see. My gripe is not about booze or drugs or the human nature aspect of it all.

What I really find disgusting & cowardly are the anons that come on board this blog and attempt to intimidate people who use their real names, state an opinion about whatever and are called idiots, stupid, pot heads, off their meds, suffering from agent orange, communist mafia types, etc by cowardly punks. As you can read I clearly have "great" sympathy and admiration for your situation and would gladly try to assist any person in a similar situation. If bars staying open can help you secure a job and you can care for you child then so be it. I'm fully aware of supply and demand as I sell art worldwide and there is no demand lately, but I feel things are beginning to move--good luck.
