They want to change the noise ordinance

Those wild and crazy kids at the Village Council's Business/Resident Liaison Subcommittee have written a resolution to modify the current Noise Ordinance.

Currently 11:00 pm is the cut off time for noise to heard outside of businesses, and residential dwellings for that matter, but the subcommittee would like this extended to 1:00 am on Friday and Saturday nights

Other than the later bar hours, do you think this might open the opportunity for live music? That is one thing I would love in the Grove a live music bar. That has music all the time. Brian mentioned this in the CG brand post.

This is not a good idea for residential areas. This would create large issues and maybe even have some legal implications such as quality of life issues in residential areas.

The Grove is a changing----zoning allowed in Codo's, who's people have rights to peace and quiet after 11:00 AM. These newcomers then filed numerous "written" complaints to Miami code enforcement who are required by city and state law to enforce the rules & regulations. Spot zoning "could" relax the rules much like David Collins (BID) closed down Commodore Plaza to traffic on weekends or closed down Gifford Lane one day a year for the Gifford Lane Art Stroll. Don't count on noise after 11:00 AM. South Miami has relaxed their noise ordinance over a period of 10 years and the people ar beginning to party in S. Miami. As a direct result of noise ordinances and code enforcement, commercial property values in the Grove have fallen by a min of $150-million. It's a well planned event. I didn't say evil conspiracy, I said well thought out financial planning.

I think 11 pm is enough for outside speakers and bands. Bring it in after that will fly for most.

What about Thursday nights? That is college night and arguably the most popular night in the Grove for the bars.

This is NOT a GOOD IDEA for residential areas. There would be legal implications such as Quality of Life. Some neighbors would be loud just annoy other neighbors.

I am all for the 5 am bar closings coming back but not this idea for residential areas.

If the Grove continues on the way it's going now, the restaurants and hangout spots won't be able to survive. Then the shops go because who will come for the day to shop if they can't eat? Then property values will spiral down even more because there will be no community. I understand the perspective that families don't want late night noise, but when house shopping why choose a house right next to an established, commercial area? Revitalize the Grove!!!

This is absolutely what the Grove needs to come back to life. Without things like music, late closings, and more inviting ideas, the Grove will become a ghost town. I understand the perspective of homeowners who object, but when house hunting why choose a place next to an established, commercial area? If the Restaurants fail-shops fail-community fails. The Grove has always been a haven for every type of activity- food, drinks, music, art, fun. Let's revitalize the Grove!

Please remember many of us Grove residents have been living here BEFORE all these bars opened for business. We all can live together as GOOD neighbors. But please just remember who is paying the high property taxes for the last 20 years to keep the Grove on the map. We are in tough times, but if we all relax things are going to get better.

The Taurus was originally established in 1919. Most of the residential areas in the Grove grew up around IT, not the other way around. And all of the businesses in the Grove pay large taxes as well, and many have been forced to close because no one is coming to the Grove anymore.

Anyone who votes for the 1am extension must prove that they live next door to any of these businesses. Or allow me to sit outside their home on the other nights of the week with my car stereo blasting at full volume while blowing my horn. Then, they can vote yes without being hypocrites.

Hi,
Can anyone please tell me where to find the current "noise" ordnance?
I practice with my band at home and have been told to turn it down. This was at 8pm on a Friday. The police told be it was an 'Anonymous" tip.
and i can be fined or arrested.
Is this true?

c. lovey, yes, type in Miami Noise Ordinance to your search engine. As to being arrested, you can be arrested for any reason at all including no reason depending on what side of the bed the responding officer woke up on. Under Miami noise ordinance the magic hour presently is 11:00 AM and in 99.99% of the time the City of Miami Police generally stick to the law. However, if you are rude to an officer they have the power to arrest you morning, noon and night-----period. I have only had run ins with 3 over the line law enforcement officers since 1965, where in my opinion they were out of line. We have good police in and around Coconut Grove---so--- again the noise by law must be lowered at 11:00 AM.

C.Lovely - listening to Jobie is dangerous to your sanity. That is a fact. According to the code, you cannot be cited for excessive noise prior to 11pm, however, a cop can cite you for other things if he chooses. However, you should challenge any such citation and would likely win. I doubt a cop would waste his time on that, but when called, they really have to show up.

11pm on a Fri and Sat night is a bit early to cut off "outdoor noise" in a lively bar area. In addition, we all know that certain bars always have had outside speakers or wide open setups that allow their inside noise to flow through the streets, while others get hassled for having customers even stand out front for a moment.

Live music in the streets is a key need and would make the block party actually happen - most people I've talked to come out and ask where the block party is, because it's basically over by 9 or 10pm.

Chances are this noise ordinance thing will never get passed, but it will be used as a bargaining chip to get the 5 am bar closings back - i.e., let us have the 5 am bar closings and we'll drop the noise ordinance extension... It gives both sides a way to say "we won!", homeowners can say they prevented the noise ordinance from being extended and businesses can say they got the 5 am bar closing back. Tricky politics!

GET THE 5 AM closings back. There used to be people who would go to South Beach and stop by the grove after at 2:00 because they could go to Sandbar, Baracuda, or Tavern and still go to Moes for a bit.
Now a lot of those South Beach people either stay there for the night or just go right home...
With Brickell having picked up in the last couple years, the same could be said for that group if we could get them out.

I was at Yard House recently with co-workers and overheard a group leaving at 12:30 debating the rest of their Friday night "You guys want to go to the grove?" "No way, it'll be closed by the time. Let's go to the beach." "OK, let's get bottles at Mynt?"
That's probably a $500 purchase that could have gone to the grove's economy. NOW think about how many times that has happened now. Where did I end up after that? Home because leaving at 1:30 and getting to the grove for a short outing didn't even seem worth it (especially since nobody would be out).

Dear that Guy. Listening to Jobie is danger to sanity, yet how would you know unless? Then you agree with Jobie and write that a "cop can arrest you for other things" which is what I said "depends on what side of the bed he woke up on". Which one of us is full of it? I use my real name and you?
