Gotta love the iniatial "disclaimer" of sorts:
"This Communication is not intended to elicit a public response"
City hall does whatever the hell they please. It's called ZERO representation for the majority of Grovites. Zero. Ask the peacocks.
Very well thought out and articulated. His points are actually spot on. Sarnoff should probably be city attorney.
It appears unlikley Miami will see any new development for many years.
Well written summary.
I like the last sentence! Facts not fears. It's a very well thought out and articulated positioning paper. I hope the other Commissioners give it due diligence and read it.
good work Sarnoff!
unfortunately, Sanchez does not have the intellectual capacity to understand it.
Bloody hell! What do you mean Sanchez does not have the intelletual capacity to understand it!! What a loser comment to make. Sanchez is as smart as a tack. Unfortunately, he is very self effacing and he likes to keep a low profile. It's refreshing to meet a commissioner without an ego. Let me ask you something... Of all the commissioners, who do you think reads through all of the material in preparation for the commission meetings? Sarnoff might but I imagine that his staff does a lot of the perusing for him. Sanchez prefers to read through reams of material so he thoroughly understands what is going on. And not second hand by someone else. Typically, you will find Sanchez burning the midnight oil reading through the material before commission meetings. Furthermore, he has a brilliant wit and amazing clarity of thinking. And all the while working his ass off trying to do right by his community. You know what, if you don't have anything nice to say, Anonymous 8:44 pm, don't say anything at all. Minnie.
There is NO WAY Miami 21 is ready to be passed. It is archaic and outdated, it was drafted years ago by Plater-Zybert and should be updated and re-presented when we have a new commission and a new Mayor. Plater-Z will have all her students and former students at the hearing - they all probably need jobs.
Bert Harris Act is an attempt to protect private property rights against laws and rules that infringe upon those rights. If Miami 21 is going to have an adverse outcome in any form or shape on private property rights then the public should be notified of such, clearly and candidly. let's not rush Miami from a pothole into a crater.
Marc is a very good lawyer. It's his job to make convincing arguments, even when he's wrong. I'm withholding judgment on the validity of the position paper until I look at what he's cited and confirm that's the law on the issue. The fact is Marc made a campaign promise to someone on the upper eastside, which has a risk of costing the City a lot of money, and he's now putting a lot of effort into justifying his position. I wonder if he'd stake his own money on this bet, and on the legal fees it would cost to defend The City even if he's right.
INQUIRING MINDS WANT TO KNOW,
Memo says: This communication is not intended to elicit a public response.
Then how did it come to end up on the Grapevine Blog? Did Grape run into Sarnoff's office and snatch it? Did someone accidentally email the pdf attachment to more than just the other commissioners?
And who the heck is going to read through that. What's the point here?
Part of the political purpose. As usual with City Hall. We're no supposed to understand, good job I can hardly read a quarter of that..
Sanchez is not the smartest knife at the table. The only thing that makes him look somewhat intelligent is Gonzalez
the whole point of the memo is to debunk Sanchez's moronic claim that there is potential for financial liability (already refuted by the City Attorney at the meeting) and that is his reason for voting against the neighborhood friendly amendments. see the bottom of page 7 that refers to District 3. Sarnoff twists the knife there.
Michelle
"has a risk of costing the City a lot of money?"
just how much risk?
really?
tell us what you truly believe, not what will inflate Sanchez's position
Steve
"This Communication is not intended to solicit a response" does not say the word "public" in it. If you read the footnote, it is making reference to the Sunshine law (see below), meaning that it is not meant to get a formal response from its recipients (aka Chairman and other commissioners). It does not mean the public should not form an opinion on it or respond to it.
This references the Florida Attorney General's opinion 2001-21, also citing 1998-79. You can read this for more information:

Michelle is correct. The only reason that Sarnoff is holding to the 35ft. limit on Biscayne is because of his stupid campaign promise to an activist fireman in the Upper Eastside. He's not concerned about the 35ft. limit. He's on the hook to the fireman voters. A shame!
Minnie I would love to know where I can typically find Sanchez burning through the midnight oil. Or more specifically, the many times you have found him.
Anonymous 7:39 am, Joe is my cousin. And you should try walking a day in his shoes. To answer your question, I have found him at Viernes Culturales, at various charitable events, at various city ceremonies, at meet & greets, visiting senior centers, pet rallies, bike rallies and the different races/walks for various charities around town. I could go on. Interestingly enough, I have never run into his opponent. Not even at the city hall christmas tree lighting (and this goes back years). 7:39 am and the rest of the coconutgrapevine readers, have a great day! Minnie.
Anon @ 11:08
I read through it, as I also read through Miami 21. And as I also read through the agenda.
Why? Because I am an informed citizen of the United States. Case in point, if you must complain about things being "political" at least read through the material. Which in that case not only can your formulate a respectable opinion you can also know when someone is trying to pull a fast one.
Oh yeah, get a thesaurus
Minnie "Joe's Cosuin"
Going out to a social gathering is not "burning the midnight oil"
Anon at 08:52 AM -- Maybe to you a social gathering is not burning the midnight oil .. but in some circles it is! You may want to widen you 'circle'!
SIGN YOUR NAME IF YOU WANT TO CALL NAMES. Thank you.
To those of you complaining that you cannot, will not or did not read the memo, I have but one thing to say: Go play with your toys while the adults are talking.
I mean that to be insulting, because if you cannot understand the simple nature of that memo, you shouldn't be taking a side on a zoning plan which you have no way of ever comprehending, and you shouldn't be commenting about your ignorance on the grapevine.
Anon@10.18, and other self-proclaimed extremely smart "adults" here who pretend to have read this Miami21 Chinese manifesto, written in a classic blend of Greek and Japanese legal verbatim of the 23rd century.
Can you please summarize the jist of it for us regular folks? Thanks for your troubles, I really don't have the time, patience or logical motivation to go through it. It's politics as usual, City Hall will do whatever they want, as always, regardless of the specific Grovite concerns. Not wasting my time even reading some of your Obviously Biased, Partisan and politically (--often downright economically motivated-) comments. Let's get back to the Peacock talk or the Brazilian Pepper dilema. Carlos Iglesia.
The City is facing a $118 mil budget deficit. Manny Diaz and his administration did not plan properly. 2010 might be worse.
Why is Diaz demanding Miami 21 be passed now? It will be another burden on the backs of the taxpayers.
Carlos
If you "don't have the time, patience or logical motivation" to read and learn what is being proposed, how can you form an opinion? How do you know whose summary of the info is correct and whose is BS?
Steve
Steve, like many of us, I perused through it, and have read enough about it on this blog and elsewhere. I haven't studied very detail and phrase or legal connotation, like 99% of the people, I bet. My opinion remains unchanged, as I stated above. Politics as usual. I'm all for a more pedestrian friendly, biker friendly, runner friendly City, of course, with preserved waterfront views and short buildings, zoning restrictions and all, of course. Miami21, in essence, is a start, better than nothing. The lawsuits issues and politics behind it I must leave to the Lawyers and Politicians, -- (bores me to death, and it stinks of partisan, personal interests )--, while preparing to wait patiently yet another Decade for something to actually GET DONE, much like the infamous Waterfront Masterplan, etc. Carlos.
Miami 21 is a zoning code that has never been used for an existing city like Miami. It will benefit the salespeople who want it on their resumes. It will cost the taxpayers plenty.
maybe you should stick to commenting on those topics if you prefer them. Nothing requires that you comment on every blog post.
Miami 21 appears to be an improvement, but imperfect. However, the current zoning laws are a trainwreck. Shall we wait for a perfect plan that satisfies every single one of every citizens interests? What will happen in the interim? Why couldn't this pass and then be improved upon or amended as it becomes clear that such is needed?
Kudos Carlos, very well put. Thank you. If only others felt the same way, progress would be imminent and possibly within reach and during our life time. SLC.
The patient (City of Miami) has cancer (budget deficit) and yet our City clowns (The Mayor and Commissioners) insist on focusing on the patients acne problem (Miami 21).
Manny, Marc, Joe, : please get your act together and focus on the real problem (BALANCE THE DAMN BUDGET BEFORE WE BROKE AGAIN)!!
When average citizens make $35,000 per year and average City of Miami firemen make $175,000 per year there is a disconnect. Bankruptcy is inevitable.
Anon 11:58 I totally agree with you. And who has the backing of all 4 unions in this Mayoral race? Tomas Regalado. I wonder what he's promised? Stick to your guns Joe....my votes with you.
