Forget the moorings, this is an eyesore

This banner popped up on South Bayshore Drive, a few days ago. It's near 17th Avenue, not to far from Mayor Manny Diaz's house.

It says, "Manny Do Your Job, Enforce City Mooring Codes! Protect This Neighborhood!"

I tried to speak with the owner of the property, but they could not be reached and after asking around all weekend, no one seems to know what it means.

Probably there are people in this neighborhood who don't like transient and/or permanently anchored vessels off the shore near their homes. The City's mooring laws were amended in preparation for the mooring field that is going to be installed outside the spoil islands near Dinner Key, and it seems these homeowners are asking that the new law be applied to keep people from anchoring off their property.

I agree with Grape. This is an eyesore. There are plenty of other ways to go about contacting the Mayor.

Sometimes with the City and the Mayor that is the only way you can get their attention. They don't listen to the people who vote.

It would be reasonable to assume they tried to contact the City for enforcement before they paid for this huge sign to be printed, but who knows?

They don't want to look at other vessels anchored offshore, however what this morons fail to realize is the ocean and the submerged lands are the public sovereign. We all have a right to use our shared resources. You want privacy? move your but somewhere that isn't adjacent to public property. I think we should load up a bunch of kayaks and have a meet and great right off this persons property.

I wrote to you about this the 2 weeks ago. There are more signs on their water side of the property, and when I was there a large dead duck on the swale right by the dock. The other signs have the City code printed on them there were 2, not sure now. This huge sign was not up 2 weeks ago just the signs on the water side. The water area is really abused and dirty looking (construction decris from a house across the street etc). Normally lots of Manatees there as well. Go check it out.

The person who says that tried to get in touch with the owner of the house obviously does not know there is a bell at the door. I went to visit the house to know what this is about and rang the bell. The whole family was inside and I was in the property within 1 min. The only thing I can say that I would not like to be them during hurricane season. If you drive by be smarter....instead of name calling look at the veranda and wood poles....totally rusted and rotten. Who would say ...I prefer not to have a water front house if I am going to have such a dangerous situation during hurricane season. My heart goes to them.

I am a neighbor of this property and I was very upset at these signs (because I see them every day on my way to work). I went to the house and talk to the owner. Now I think that I would pretty much do the same because hurricane season is coming and those boats are tide to nothing. He tried for many months to get in touch with the City. Nothing has gotten done. Now I actually applaude him because he has guts to try anything to defend his family and property.

I am also a neighbor of this property owner and this individual has been agitating and intimidating the neighborhood for several years now. The boats in question (3) are owned and moored by homeowners in the Fairview subdivision. When this subdivision was developed in the thirties the homeowners were granted two access easements and riparian rights to the water. One is to the south (along the east side of the Grove Harbor condominium) and the other is the strip of land on West Fairview next to the water and turning basin. These rights are conveyed in the deeds of the 20+ homeowners in the subdivision. There has been a dock there since the thirties. The dock is regularly maintained and comparable to many structures along the Bay. When a hurricane approaches, the boat owners are very diligent about securing their vessels so as to minimize damage to their boats or to adjacent the properties. During Wilma, the most recent hurricane with any storm surge, none of the boats dragged or broke free of their moorings. Unfortunately, these are only 3 boats that he has to concern himself with as there are another 15 boats moored along the canal and basin that could with a significant storm surge potentially land in his back yard. My guess is that the property owner's concerns regarding loose boats during hurricanes is a diversionary tactic from his more real desire to have an unobstructed view out the back of his property. He has hired numerous attorneys and spoken to all the City officials from the Net office to the Mayor's office without success because the property owners in the Fairview subdivision have a legal right to this property. Now he has taken his case to the general public by posting signs (illegally, he has been cited already). I could go on but and have already taken up too much space on this blog.

whoever just wrote the last blog obviously has not driven by and has not seen the rusted veranda and rotten poles. I looked around and those boats are the only ones tied to a rusted veranda. You can actually put your hand through one of the bases. It is weird that people can actually defend that marina. I think it has to be only the neighbors that have access to use the marina. If somebody defends the existence of this marina, it has to be bc they have an agenda. I drive by every morning and before the signs I was always appalled by the situation of the boats and poles.

I was the prior anonymous post. I am not one of the boat owners and this mooring certainly does not constitute a marina but rather a simple dock. I don't disagree regarding the appearance of this railing and strip of land and would like to see it relandscaped and painted Accept for one place the railing is actually quite sound. About two years ago, some of the homeowners put soil, sod and coral rocks there to improve the appearance of the swale. Unfortunately, someone in the neighborhood poured an oil/gas mixture on the newly planted sod and it died and has never recovered. If you pass the area daily, you will also note that someone puts their palm fronds and cuttings on the swale and draped over the railing. My take is that someone wants this area to look as bad as it can look in order to bolster their position. This in an unfortunate neighborhood disagreement that could be resolved reasonably if the parties were interested in doing so. Instead there have been threats, incidents of theft (resulting in an arrest and trial) and property damage in an effort to intimidate. If the condition of the pilings and railings there were truly the principal concern of this home owner then an easy solution would be to request that the boat owners improve and upgrade them in order to provide some assurance that they will not fail in the next hurricane. But, this is not what he wants. He wants all of the boats removed. Needless to say, there is more to a particular story than what you read on the cover. Be assured, the City (the Mayor included as he lives in this subdivision) is very much aware of what's going on with this property owner. I think most in the neighborhood would like to be able to move on without anymore threats or upset.
