Another blow to the Related Group project
Administrative Judge J. Lawrence Johnston ruled that the change to the City of Miami's comprehensive plan, necessary for the 300 Grove Bay Residences project, was not in compliance with the state planning guidelines.
Today's ruling follows another Court's finding, last May, that the zoning change constituted spot zoning. Spot zoning is where a zoning change is made for a particular parcel without regard to the surrounding neighborhood. With these findings, two of the three necessary approvals for the project have been voided. A third court challenge to the project is pending before Judge Pedro P. Escharte, Jr.
John C. Lukacs and Patrick J. Goggins, attorneys for petitioners Grove Isle, and neighbors Constance Steen, and Jason Bloch are pleased with the Court's ruling. "This represents a victory, not just for Coconut Grove, but for the entire city," said Goggins, "High rise development belongs downtown."
"I am delighted [with this latest ruling]," said Mrs. Steen. "If this project goes thorough this would be the end of north Grove. Europeans have put moratoriums on huge condos all around Europe and it's about time we do that here."
The decision is not final, the respondents have fifteen days to take exception to the Court's order.
