Related/Mercy project to be scrapped? Herald Story here.

From the Herald story: "
One particular finding by the judges -- that the rezoning sought by Related was so out of character with the neighborhood that it amounted to ''spot zoning'' -- that is perhaps most damaging to the project's chances."

Judges Antonio Marin and Beatrice Butchko.

Perez will no doubt appeal this thing, if for other reason than his bruised ego. Related also has big problems in New York state, where a bunch of Miami condos were unloaded on New Yorkers without some sort of in-state paperwork for out-of-state sales. That, plus the overall condo glut and the several downtown projects that have yet to come on line. Not the best of times for the recent publication of ole Jorge's self-congratulatory book outlining how you too can aspire to achieve his cosmic visionary business acumen.

This is very good news indeed.
Its not over yet, there is still the appeals process.
It is a shame that the only way our community seems to receive justice (Fire Fee and now Mercy rezoning) is through the court system.
All those that voted yes on this illegal spot-zoning(Sanchez, Gonzalez, Spence-Jones and Diaz) should be fined and or fired. In fact, all spot-zoning should now be reversed (and there are many).
I wonder if the Natoma and Bay Heights Homeowners association will be returning the money to the Related Group!
They should be fined for accepting that bribe.
It proves once again that a No Vote by Marc Sarnoff and Tomas Regalado is the Right Vote for our community.

Thank you Atty John Lucas for standing up for our community.
Thank you Developer John Hinson, who was leading the opposition on behalf of the Vizcayans.
Thank you Judges Antonio Marin and Beatrice Butchko who formed the majority in invalidating the city's previous approval of the condos.
No thanks to Judge Spencer Eig, a former law partner of Manuel Diaz, who dissented and voted in favor of the city (Should have been recused).
Coconut Grove and the City of Miami are much better off as a result of this wise ruling.

Interesting that the only Judge that voted in favor of the City and Related was the lead attorney and partner of Manny Diaz in the Elian case.

YES!!! A great victory for the Grove as a whole. Thank you to the Judges and the those who fought this in court and thank you Marc Sarnoff for your neighborhood-based support and for baiting Manny into the Jennings Law violation.

I can tell you as a Bay Heights Homeowner, that we never saw a penny of that money. Furthermore, when I called our association President, Mr. Murray Marcus to ask him about the money and the deal with Related, he almost killed me. I can surely say that about 90% of the Homeowners were never informed of this deal with Related. I am very happy that it is not happening, as it would be a traffic nightmare for everyone, but the only one getting any money from this deal is Mr. Murray Marcus
